We have mentioned it before, and will mention over and over, Amalana will never under any circumstances subject your information, privacy, and end-user experience to any sort of misuse. Use of Services provided by Amalana

Amalana prides in the services which it has developed. Therefore, in order to ensure that its end-users experience the best global networking services experience, it has put together these Terms & Conditions. The following are some rules and regulations pertaining to the use of services provided by Amalana. Please do read this carefully.

In order to access certain services, you may be required to provide information about yourself as part of the registration process for the service, or as part of your continued use of the services. You agree that any registration information you give to Amalana will always be accurate, correct, and up-to-date.
You agree to use the services only for purposes that are permitted by the Terms & Conditions and any applicable law, regulation, or generally accepted practices or guidelines in the relevant jurisdictions including any laws regarding the export of data or software to and from the United States or other relevant countries.

You agree not to access or attempt to access any of the services by any means other than through the interface that is provided by Amalana, unless you have been specifically allowed to do so in a separate agreement with Amalana. You specifically agree not to access or attempt to access any of the services through any automated means including use of scripts or web crawlers and shall ensure that you comply with the instructions set out in any robots.txt file present on the services.

You agree that you will not engage in any activity that interferes with or disrupts the services or the servers and networks which are connected to the services.

Unless you have been specifically permitted to do so in a separate agreement with Amalana, you agree that you will not reproduce, duplicate, copy, sell, trade or resell the services for any purpose.

You agree that you are solely responsible for (and that Amalana has no responsibility to you or to any third party for) any breach of your obligations under these Terms & Conditions and for the consequences including any loss or damage which Amalana may suffer of any such breach.

Amalana's Privacy Policy

Amalana's end-users' privacy is of extreme importance to us. We will never under any circumstances divulge any information about you. The information we collect is used to improve the content of Amalana, used to notify end-users about updates to Amalana. Information will only be disclosed when legally required to do so, at the request of governmental authorities conducting an investigation, to verify or enforce compliance with the policies governing Amalana and applicable laws or to protect against misuse or unauthorized use of Amalana. Amalana's is dedicated to your Safety

Amalana regards its end-users' safety as vital for a great global networking service' experience. However, in order to achieve this, we need your help to avoid any potential risk factor. Amalana will not tolerate any misuse or any potential risks which may cause harm to its end-users, but we cannot guarantee it. Having said that, we ask that you assist us in enforcing your safety by committing to the following conditions:

  1. You will not share any of your personal information (such as home address, telephone number, credit cards, etc) with people whom you do not know.
  2. You will not divulge your information to third parties. Amalana treats its end-users' information and privacy with very high level of importance so we ask you to do the same in order to avoid any issues which may arise.
  3. You will not send or otherwise post unauthorized commercial communications to end-users. Spam will not be tolerated and will result in termination of account.
  4. You will not collect users' information, or otherwise access Amalana, using automated means (such as harvesting bots, robots, spiders, or scrapers) without our permission.
  5. You will report any misuse of Amalana's services immediately to privacy@amalana.com.
  6. You will not upload viruses or other malicious code with the intent of disrupting Amalana's services.
  7. You will not divulge any login information or access an account belonging to someone else.
  8. You will respect other end-users using Amalana's services. Harassment will not be tolerated and will result in termination of account.
  9. You will not post content that is hateful, threatening, pornographic, or that contains nudity or graphic or gratuitous violence. Racism, sexism, or any behavior which is deemed inappropriate by Amalana will not be tolerated and will result in termination of account.
  10. You will not develop or operate a third party application containing, or advertise or otherwise market alcohol-related or other mature content without appropriate age-based restrictions.
  11. You will not use Amalana to do anything unlawful, misleading, malicious, or discriminatory.
  12. You will not violate or assist in violating any of these Terms & Conditions.

Amalana's Registration & Account Security

Amalana end-users provide their real names and information, and we need your help to keep it that way. Here are some commitments you make to us relating to registering and maintaining the security of your account:

  1. You will not provide any false personal information on Amalana, or create an account for anyone other than yourself without their permission.
  2. You will not use Amalana if you are under 13. We ask you to help us enforce this policy. Any reported accounts of such will be terminated following thorough investigation.
  3. You will ask for your parents' consent if you are between the ages of 13 and 18.
  4. You will not use Amalana if you are a convicted sex offender. Amalana will monitor its website and any suspicious behavior will not be tolerated and will result in termination of account.
  5. You will keep your contact information accurate, up-to-date, and fully cooperate with Amalana should additional identity verification is requested.
  6. You will not share your account with anyone. End-users must have individual accounts in order to avoid any potential issues.
  7. You will not share your password, let anyone else access your account, or do anything else that might jeopardize the security of your account.
  8. You will not transfer your account to anyone without first getting our written permission.

Amalana's Commitment to protecting others' Rights

Amalana respects others' rights, and expect you to do the same. Therefore, we ask you to please comply with the following:

  1. You will not post content or take any action on Amalana that infringes someone else's rights or otherwise violates the law.
  2. We can remove any content you post on Amalana if we believe that it violates these Terms & Conditions.
  3. If we removed your content for infringing someone else's copyright, and you believe we removed it by mistake, we ask you to contact us at privacy@amalana.com with an accurate explanation of the reasoning behind the content which has been removed. It remains under Amalana's discretion to decide whether you are allowed to repost the content removed or not.
  4. If you repeatedly infringe other people's rights, we will terminate your account.
  5. Every person is entitled to feeling secure. Amalana will not tolerate any misbehavior, threats, or any other incident which may result in potential harm of its end-users. We encourage you to report any known incidents to privacy@amalana.com. We take these matters seriously and will act accordingly.
  6. You will not use our copyrights, trademarks, or any of our information without our written permission.
  7. If you collect information from end-users, you will obtain their consent, make it clear you (and not Amalana) are the one collecting their information, and post a privacy policy explaining what information you collect and how you will use it.
  8. You will neither jeopardize your nor others' account information. Amalana strives to enforce a secure and private environment and we ask you to do the same.
  9. You will not post anyone's identification documents or sensitive financial information on Amalana.
  10. You will solely be held responsible for any misuse of others' account information.

Amalana's Payment Conditions

If you make any payment to Amalana, you agree that you have completely read and understood our payment conditions for the respective product or service. Should you have any questions pertaining to the requested service, please contact us at payments@amalana.com.

Advertising with Amalana

Amalana strives to allow all its end-users to benefit from its advertising services. However, it remains under Amalana's discretion whether we accept or reject your advertisement. We shall notify you of our decision upon submission of your request. In order to ensure that your advertisement is deemed appropriate and acceptable, please provide us with as much detail as possible about your advertisement, the purpose of your advertisement, and your respective goals. Amalana will prohibit any advertisements which violates the law including pornographic, racist, sexist, or any such advertisements which Amalana deems inappropriate to be advertised on Amalana's website. If you are also advertising on someone else's behalf, Amalana needs to ensure that you have permission to do so. Therefore, a written consent may be requested at anytime to ensure that Amalana's Privacy & Security policies are intact. Amalana will not advertise any content you provide unless you completely understand and agree to the advertisement conditions and your expectations are set accordingly. Amalana will do its best to assist in achieving your respective aspirations for advertising with us, but we cannot guarantee your campaign's success nor are we responsible for click fraud or other improper actions that affect the cost of running ads. By advertising with Amalana, you also agree that we may use your advertisement for marketing or promotional purposes. Should you wish to cancel your advertisement campaign with Amalana, you must provide us, in advance, with a seven working day notice in order for us to take the appropriate measures. You will also not issue any press release or include the name of Amalana, its trademark, or any other information without our written consent. You also agree that should you violate any of these Terms & Conditions, Amalana may hold you responsible for this violation. Amalana's Termination of your Account

Amalana will never terminate your account for no reason. However, should you violate these Terms & Conditions highlighted on this page, or create possible legal exposure for us; we can stop providing all or part of Amalana to you. We will generally try to notify you, but have no obligation to do so. You may also delete your account or disable your application at any time.

Disputes with Amalana

Amalana has been established in order to provide its end-users with unprecedented global networking services experience. However, although we do not anticipate any disputes or issues with our end-users, it could happen. We prefer to resolve all disputes and issues amiably and without need to revert to legal aid. Therefore, we encourage all end-users to contact us at disputes@amalana.com. However, should legal interference necessitate resolving any inconsolable issues, the following measures need to be taken in consideration:

  1. You will resolve any claim, cause of action or dispute ("claim") you have with us arising out of or relating to these Terms & Conditions or Amalana in a state or federal court determined by Amalana. The laws of the State of California will govern these Terms & Conditions, as well as any claim that might arise between you and us, without regard to conflict of law provisions. You agree to submit to the personal jurisdiction of the courts determined by Amalana for the purpose of litigating all such claims.
  2. If anyone brings a claim against us related to your actions or your content on Amalana, you will indemnify and hold us harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim.
  3. WE TRY TO KEEP AMALANA UP, BUG-FREE, AND SAFE, BUT YOU USE IT AT YOUR OWN RISK. WE ARE PROVIDING AMALANA "AS IS" WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT AMALANA WILL BE SAFE OR SECURE. AMALANA IS NOT RESPONSIBLE FOR THE ACTIONS OR CONTENT OF THIRD PARTIES, AND YOU RELEASE US, OUR DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS FROM ANY CLAIMS AND DAMAGES, KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH ANY CLAIM YOU HAVE AGAINST ANY SUCH THIRD PARTIES. IF YOU ARE A CALIFORNIA RESIDENT, YOU WAIVE CALIFORNIA CIVIL CODE §1542, WHICH SAYS: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR." WE WILL NOT BE LIABLE TO YOU FOR ANY LOST PROFITS OR OTHER CONSEQUENTIAL, SPECIAL, INDIRECT, OR INCIDENTAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS STATEMENT OR AMALANA, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Amalana Definitions

  1. By "Amalana" we mean the features and services we make available, including through (a) our website at www.amalana.com and any other Amalana branded or co-branded websites (including sub-domains, international versions, and mobile versions); (b) our Platform; and (c) other media, devices or networks now existing or later developed.
  2. By "us," "we" and "our" we mean Amalana and/or its affiliates.
  3. By "Platform" we mean a set of APIs and services that enable applications, developers, operators or services to retrieve data from Amalana and provide data to us relating to Amalana end-users.
  4. By "content" we mean the content and information you post on Amalana, including information about you and the actions you take.
  5. By "post" we mean post on Amalana or otherwise make available to us.
  6. By "use" we mean use, copy, publicly perform or display, distribute, modify, translate, and create derivative works of.

Other

  1. These Terms & Conditions make up the entire agreement between the parties regarding Amalana, and supersedes any prior agreements.
  2. If any portion of these Terms & Conditions is found to be unenforceable, the remaining portion will remain in full force and effect.
  3. If we fail to enforce any of these Terms & Conditions, it will not be considered a waiver.
  4. Any amendment to or waiver of these Terms & Conditions must be made in writing and signed by us.
  5. You will not transfer any of your rights or obligations under these Terms & Conditions to anyone else without our consent.
  6. All of our rights and obligations under these Terms & Conditions are freely assignable by us in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise.
  7. Nothing in these Terms & Conditions shall prevent us from complying with the law.
  8. These Terms & Conditions do not confer any third party beneficiary rights.

If Amalana decides to change its Terms & Conditions, we will post those changes on this page, and/or update the Terms & Conditions modification date below.
